More California Towns Call for Impeachment

Berkeley has joined three other California cities in calling for the impeachment of President Bush and Vice President Dick Cheney.

In a resolution that will be sent to U.S. House Speaker Dennis Hastert, R-Ill., the Berkeley City Council accuses the president and vice president of, among other things: defrauding the country and Congress regarding the Iraq war; authorizing torture in violation of the Geneva Conventions; ordering secret surveillance of U.S. citizens; and failing to respond quickly to the Gulf Coast hurricane.

More than a dozen lawmakers on Tuesday introduced a resolution calling for President Bush’s impeachment, making the Vermont Legislature the (third) in the nation (along with Illinois and California) to consider such a move.

Introduced by Rep. David Zuckerman, P-Burlington, and signed by 12 other Democrats, Progressives and the body’s lone independent, the resolution requests that Congress “initiate impeachment proceedings against President George W. Bush” under an obscure set of rules that allow state legislatures to directly seek such an action.

It comes a little more than two weeks after the Vermont Democratic Party decided to write a letter to Congress seeking impeachment, and a day after a similar resolution was introduced in the Illinois Legislature.

“George W. Bush has committed high crimes and misdemeanors as he has repeatedly and intentionally violated the United States Constitution and other laws of the United States,” Zuckerman’s resolution said.

Why Impeachment?

While impeachment is a very serious step that should not have been trivialized the way it was during the last presidential administration, it is also an indispensable part of a system of checks and balances that sustains our democracy. When strong evidence exists of the most serious crimes, we must use impeachment or lose the ability of the legislative branch to compell the executive branch to obey the law.

This is not a question of supporting one party over another, but of upholding the rule of law over both of them. The Democrats will resist impeachment of Bush and Cheney as fiercely as the Republicans until the people of the country force it on them. And we are not doing so to promote a party, but to protect our democracy.

Our democracy and the values we uphold are endangered. Open government has been replaced by secrecy. The rule of law has become the rule of the presidential signing statement in which one man rewrites the laws passed by our elected representatives.

Bush and Cheney have seized powers that belong to Congress, and have done so by intentionally misleading Congress and the American people about the fictional threat from Iraq, about spying on us without court approval, about torturing, and about shredding our civil liberties.

The following charges warrant impeachment proceedings:

1-Intentionally misleading Congress and the public regarding the threat from Iraq in order to justify a war against Iraq, and intentionally conspiring with others to defraud Congress in this regard. These actions are not just criminal in a rhetorical sense. They are felonies, violating the federal anti-conspiracy statute and the False Statements Accountability Act.

2-Ordering the National Security Agency to conduct electronic surveillance of American citizens without seeking warrants from the Foreign Intelligence Surveillance Court of Review, as required by law, specifically, Title 50 United States Code, Section 1805. Bush has openly confessed to this crime but claims to have the right as president to commit it. The right of a president to secretly violate the laws of Congress, while lying to the public about it, does not exist in the US Constitution. The right of the same president to continue his criminal behavior after it’s discovered is also not to be found in US law.

3-Conspiring to commit the torture of prisoners. Bush and Cheney say they do not torture. The evidence overwhelmingly says otherwise. This crime violates the “Federal Torture Act” Title 18 United States Code, Section 113C. It also violates the UN Torture Convention and the Geneva Convention, which are U.S. law under Article VI of the U.S. Constitution, which makes treaties ratified by the US part of US law.

4-Ordering indefinite detention without access to legal counsel, without charge, and without the opportunity to appear before a civil judicial officer to challenge the detention, all in violation of U.S. law and the Bill of Rights.

A week after Neil Young received headlines for his new work which criticizes the Bush Administration, another major international rock band has joined others in the industry by stating that they support the impeachment of George W. Bush. The Red Hot Chili Peppers made the statement by posting to their official website.
“George W. Bush should definitely be impeached, he is a liar and his lies have bought misery to millions of people and bought no good to anyone except for the corporate oil billionaires who are making huge profits,” Peppers bassist Flea said in the statement.

A New Thing to Remember: Section 603

State legislature in California and Illinois are using a little known and never utilized rule of the US House of Representatives, Section 603 of Jefferson’s Manual of the Rules of the United States House of Representatives, which allows federal impeachment proceedings to be initiated by joint resolution of a state legislature.
According to Section 603 of Jefferson’s Manual, “there are various methods of setting an impeachment in motion”: 1) By charges made on the floor by a member of the House; 2) By charges preferred by a memorial filed by a House member; 3) By charges contained in a Resolution introduced by a House member; 4) By a message from the President; 5) By charges transmitted by a State legislature, or a grand jury; 6) By facts developed and reported by an investigating committee of the House.

In number 5, the rules allow for charges to be submitted by the State legislature if the voting parties have voted to do so.

California Joins Illinois to Call for Impeachment

Joining Illinois, California has become the second state in which a proposal to impeach President Bush has been introduced in the state legislature. And this one includes Cheney as well.

(where the LA Times has now called for Cheney’s resignation) has submitted amendments to Assembly Joint Resolution No. 39, calling for the impeachment of President George W. Bush and Vice President Richard Cheney. The amendments reference Section 603 of Jefferson’s Manual of the Rules of the United States House of Representatives, which allows federal impeachment proceedings to be initiated by joint resolution of a state legislature.

Proof Emerges Bush Lied America Into Iraq War

The growing nation-wide effort to impeach George W. Bush and Dick Cheney is emblematic of a larger issue: what kind of country is the United States to become.

Yesterday’s news brought out two explosive pieces of information:

1) Lewis Libby, the indicted chief aide to Dick Cheney, has admitted under oath before a Federal Grand Jury that it was George W. Bush himself who authorized Libby to illegally “leak” classified information to New York Times reporter Judith Miller in July, 2003 in an effort to discredit Ambassador Joseph Wilson who had publicly stated that “there is nothing to the story” that Saddam Hussein’s government was trying to buy uranium for a nuclear weapons program. Wilson is the husband of Valerie Plame, the undercover CIA operative whose identity was revealed to the media as retaliation for Wilson’s contention that Bush’s assertions about Iraq’s Weapons of Mass Destruction were false. The “classified information” that Bush and Cheney authorized Libby to plant in the New York Times turned out to be entirely false.

2) Bush’s Attorney General admitted yesterday that Bush believes that he has the authority to personally authorize the secret wiretapping, without any court order, of any and all conversations and emails between Americans that occur exclusively within the borders of the United States. Earlier it was revealed that Bush set up a massive secret wiretapping operation monitoring a huge number of Americans, but he had asserted that it was only to listen in on conversations of people in the United States who were making international calls and emails.
The fact that Bush has not already had articles of impeachment filed in the House of Representatives is clear evidence that the people must act forcefully as the true guardians of the Constitution and the Bill of Rights. That is exactly what the ImpeachBush.org movement is doing. When impeachment looked remote, there were still tens of thousands of individuals who tirelessly worked to collect petitions, hold rallies, wrote and called members of Congress and donated so that we could place newspaper ads all across the country.
Today, impeachment is not remote at all. It reflects the majority sentiment. Recent polls show that by 52% to 43% majority the American people favor impeachment if it is proved that Bush lied about the reasons for going to war. A nearly similar majority support impeachment if the President broke Federal wiretapping laws by authorizing the secret wiretapping of Americans without a court order when there is no evidence or inquiry of criminal wrongdoing.
Yesterday’s revelations confirm again that this is a lawless administration. Impeachment is imperative. This is a challenge for every person in this country who has a commitment to the Constitution. The people must continue to act rather than wait for the politicians to lead.
Now that more than 700,000 people have voted for impeachment at http://www.impeachbush.org/ it is urgent that we do everything in our power to make the issue of Bush’s criminal conduct a major issue between now and the November Congressional elections. The newspaper ads are an excellent way to keep the issue of impeachment front and center. More Impeachment Calls in the Northeast

It would be a considerable overstatement to say the fledgling impeachment movement threatens to topple a presidency — there are just 33 House co-sponsors of a motion by Rep. John Conyers, D-Mich., to investigate and perhaps impeach Bush, and a large majority of elected Democrats think it is a bad idea.

But talk bubbles up in many corners of the nation, and on the Internet, where several Web sites have led the charge, giving liberals an outlet for anger that has been years in the making.

“The value of a powerful idea, like impeachment of the president for criminal acts, is that it has a long shelf life and opens a debate,” said Bill Goodman of the Center for Constitutional Rights, which represents Guantanamo Bay detainees.

Vermont Town: Lucky #7?

Local organizers who want the town of Rockingham to support a motion of impeachment hope to raise the question at the special town meeting scheduled for this Thursday.

A similar motion passed in Newfane, Putney, Dummerston, Marlboro on Town Meeting Day and Brattleboro at its representative town meeting.
